Hi,
I filed for my I-140 last month and got a reciept notice. Based on the processing times it looks like it might take atleast 6 months for my I-140 to get approved. My priority date is 07/2004 EB3. In case EB3 dates move this month and my PD becomes current, Can I still file for my I-485 this month even if my I-140 is not approved yet?
FYI,
I cannot file for I-140 premium processing as I have filed for I-140 with a substituted labor.
I appreciate all of your comments.

Thanks for bringing this up. In the byzantine world of USCIS regs this probably got lost somewhere?
But i agree with the post above .. we are really stuck between a rock anda hard place on this issue..If we ask them to move all spouse visa numbers to Family , which is how it should be based on the legislations you are quoting, then our partners will have to wait for more number of years than EB categories. It does not matter that EB3 is now U. my feeling is in the long run EB is a better category than FB....
Also it could present more issue for all those aged out folks who are at least in EB where the gravy train seems to be inching unlike the FB train... And we don't even need to scenario plan the FB if all our spouse appln goes in to taht bucket.. But there is an advantage.. the primary applicant could get their GC cards faster (I am assuming) and this probably may be truer (if there is anything like that) for India and China, where usually the EB applicantion includes spouse/child visa reequest as well..

depression is created by anxiety and hopelessness.
I am also like many others, suffering from GC related depression. After reading the posts, now I feel more comfortable that I am not alone:)
Two steps I wish to take: (1) Not to think about getting GC any more. Whether I am anxious or not, it will take its own time and let me develop the habit of patiently waiting (2) Have a back-up plan ready.

Ha ha Congrats....
Story of my life. I complain about delay with my application. Someone joins me and tells me they are in the same boat and the very next day that someone leaves the boat and jumps into "greener" pastures. Everyone is leaving the boat and I seem to be left out :(
Who else are in my boat? (Application with an officer for over 2 weeks and still status = "Initial Review")
me too in same boat. :) In my case USCIS have wrong priority date on my case. On their records it somehow shows Jan 2006, while it should be Jul 2003. I have tried to get it resolved but they haven't done anything about it [had tried Ombudsman (7001), Senator, congressman, SR etc]. Funny thing is even the incorrect priority date is current now. And still waiting for GC for over a month :mad:

I am happy to see some beginings here.. although we have had many many threads before for this kind of initiative but I see some difference here... Like some others said we need to draft an action plan from A to Z here (understood that it may not be exactly what we would be following over time but), we need some roadmap to follow to reach our target.
I like the idea of collecting info about who is willing to contribute and I am all for it.
btw, option 1 is not an option for me.

Ok that is funny. So I have been waiting for 6 years now here and that is nothing. some kid comes in here and struggles to complete his MS and then just works for 3 years and gets in line before me !!
Not trying to sound negative here but it looks like a lot of people here are Masters ( either in EB2 or EB3 ) ?
I guess you do not have the slightest idea of the struggles and financial uncertainty of studying in the U.S. As a matter of fact THIS IS FAIR. Did you know that it cost over $20 K to go to school here just in tuition (with out any assistantship's, which is the norm for over 5 years now with the bad economy first and the lack of funding to graduate schools across the country) and most people who come on student visas gain experience through internships( on OPT's and CPT's) making as little as $10/ hour, not to mention working for minimum wages as they study to make ends meet and then and finally the effort of paying off student loans back home. Not only that a majority of people who come on F1 visas to U.S educational institutions pursue Advance degrees in not so "lucrative" fields in terms of job prospects like core engineering fields, pure sciences and many of them go on to get PhD and become researchers.
That is exactly what the U.S wants; they want the brain drain to resurface to bring about innovation in engineering and sciences. The only folks that come to work directly in the U.S are the IT folks so you are looking at a small spectrum of people. Again this is a long awaited gesture from U.S immigration system to people's trials and tribulations who take the long and winding road to pursue advance degrees in the U.S and eventually get on to work and enhance their professional goals.

Section 202 of the Immigration and Nationality Act (INA) states that the per-country limit for preference immigrants is set at 7% of the total annual employment-based preference limits. This means a country with large population like India and a tiny country like Lichtenstein get same number of visa numbers. This system is designed to systematically discriminate people from India and China by preventing them from attaining employment visas. More research needs to be done whether this constitutes a violation of US Equal Employment Opportunity Law. We need to find out whether this constitutes discrimination by national origin. Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.
May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

My status on CRIS has changed. No emails. Its says my approval has been sent. But nothing about the card. I spoke to the CS and they said my biometrics have to be uploaded. In the mean time can I get my passport stamped?
One of my friend was in your situation. He got the I797 stating that 485 was approved. He took infopass and got the passport stamped. Hope this helps.
