    22CFR 42.32 is not the law.
    INA is the law.

    Holy cow... I cannot believe, I got my green card today...

    My online case status changed to card production ordered today (1 hour ago).

    I had filed during july fiasco and was not abel to send my medical tests , so had got RFE.
    Then i took the medicals and sent the response in july 2009, and the status remained RFE response received for a long time.

    I called NSC and opened a service request on Aug 18.

    Guys believe me Service Request does miracles, they just approved it now.

    So my journey came to an end after 7 years.

    If I got green card, the whole credit goes to IV. You guys are really great, learnt a lot from this forum. Kudos to you all...

    I will continue to visit these forums and help as much as I can.

    I still cannot believe I got it.

    Positive programming. Could we start it inside ourselves first? Stop ranting and lamenting?


    The point is not that tri-state was crooked etc. The point is, they got the cash because they made themselves known as an entity that does some service

    Same with IV. If IV is just a rant board, who will believe? We must change IV!

    Well, it goes beyond that. This is a "complicated story with no sub titles".

    IV website is a board where people of all kinds visit and there is no control over stuff. Just go to any blog site - we see 100 rants and crazy comments as against a few wise talk.

    I guess we have to live with it and keep pushing people. Sometimes loud and sometimes gently.

    I never claimed I'm going to refrain from going ballistic with words when insults are hurled at me! Maintaining high moral standards and bad language usage doesn't always have to be mutually exclusive. Your logic is waaaayyyyyy flawed if you think they are, my friend!

    Coming to your point about F1 status, I can speak for myself that I did come to the US with the intention of going back. I was offered a job while I was still in school and I changed my mind only then. My statement earlier is not conveying my intentions clearly.

    It is also true that if USCIS needed to enforce that students are requried to go back to their home country after school, then they should not issue a COS with the H-1B approval, forcing the student to re-enter.

    Many of your posts are sensible but you use language which does not befit your self-imposed imaginary high standards. Anyways, the quoted statement itself shows moral contradictions and you have misrepresented your intentions when you went to the consulate. F1 is a non-immigrant visa with the underlying implication that you return to your home country. Please get off your high horse.

    Receipt# is printed on check after it's cashed.

    In my case, my employer asked me to make checks payable to employer (for attorney fees as well as filing fees) and they cut the check for USCIS and attorneys. I don't understand how it helps them but delays in my getting the receipt#. If they let me pay directly to USCIS, I could at least get the receipt#s. My I-485 was received at NSC on 06/04/2007 morning.

    I am a 2 July 2007 filer. Many SR's and calls later no FP.But I applied for EAD and AP renewal last week.I got the FP notice in mail today.

    So I think that the renewal may trigger a FP notice.

    Now just see the pattern, the moment we start talking about donation and volunteering .. the guys sitting on the sidelines distracting and demotivating , stopped being part of the conversation. Everyone says I am rude, not I am not I just show the mirror as it is.. what can I do if you see the ugly face in it.
    How good the group can be , which is actually missing when you need the count.
    IV made so many effort to keep the group attracted to this, by ask a attorney for free and other things.. I don't think the group deserve all this..
    They might thank you if you can put up a shortcut for the pathetic visa bulletins published every month.

    This is not correct from legal point of view. I would put this statement as
    -- Must have valid work authorization. Sponsorship for any work visa is not offered.

    Employer can not ask for kind of authorization. It could be, EAD, OPT, GC etc. As long as applicant is qualified as per I-9 form, kind of authorization should not matter.

    Of course, H-1B applicant can not apply for this job position since visa sponsorship is not available.

    First of all congrats man!
    You experience gave so much hope on my green card process�

    Buddy,

    This is an ultimate test from above on our patience.

    I waited for a very long 10+ yrs for my process to complete. Will you beleive that during the first 3 yrs of my application all the categories were current. The very next month when my labor got approved it went to retrogression. Before I got greened 2 weeks back, the dates became current for 3 times. I missed all 3 times. Last one was becuase of idiot lawyer (her firm is one of the largest immigration law firms in the entire country) sat on it and did not provide a required paper work.

    After that the wait got extended for another 3 more yrs. finally got it on early part of this month. With the same process I was laid off once. Ported the process out. Then second company tried to ditch me the process. Ran away from their with the process. Got really lucky. From 3rd company I was forced to take a package and leave. Got lucky there too to port the case for a record 3rd time. Filed AC21 with the 4th company. Later filed I 140 again (i don't know why. The lawyer of the cmpany insisted). Got that once also approved.
    Spend almost 38,000.00 dollars in all these various processes. After all these waited for almost another 2 yrs again and finally it arrived.....

    So each story is different. Each has got its own colors. I have worst situations than mine. Just hang in there buddy. Your turn is round the corner. It is on its way.

    either you have a chicken heart or you are a silent partner of a blood s#$king deshi consulting.
    kg318, this is your money and you earned it. Don't give these suckers any option to suck your earned money. Charging for GC process in any stage is totally illegal no matter which state you are from. It is DOL and USCIS policy not of a state.

    I see some people trying to talk here in favour of employers straight or some times using curves. Remember kg318, there are members here who have consulting company ties and who here talks for them as well. Be judgmental.

    kg318... from your initial post you indicated that you "demanded" money back and noted that Company A's practice was "against the law". Now, they are using the same law against you. Not saying it is fair or pretty. Just remember, what you sow, you shall reap.

    It is generally poor practice to go for gung-ho activism in a situation where you are unclear about the law (e.g., non compete) and unable to get good counsel (e.g. immigration and business law attorneys).

    Just keep this in mind. Long term, your peace of mind is worth more than $4K ... just think if there are other ways in which you could have handled this.... in case such event pop up again.

    If I were you, I would have a civil conversation with that company. Tell them that economics took over empathy, that you wish to be in a position where you have less financial loss and would appreciate an amicable parting of ways.
    It's a small world out there. Dont pi*s on anyone, lest it come back to wet your backside!

    Sabre rattling might get you out of this one, but the world still remains a small place!
